1. Introduction

These Terms and Conditions (“Terms”) govern the provision of services by Attendance Allowance Services Ltd (“AAS”, “we”, “our”, “us”).

By engaging our services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not proceed with our services.

2. Our Services

AAS provides professionally led support to assist individuals of State Pension age with applications for:

* Attendance Allowance (AA), and

* Pension Age Disability Payment (PADP – Scotland).

We provide two distinct services, which may be taken independently or together.

2.1 Clinical Consultation & Assessment Service

This service is delivered exclusively by HCPC-registered Occupational Therapists (OTs).

Purpose

The clinical consultation assesses how a person’s diagnosed medical conditions affect their functional ability, daily living activities and need for supervision or assistance.

This service includes:

* A structured clinical consultation conducted by a registered Occupational Therapist

* Review and discussion of medical conditions and functional limitations

* Professional clinical judgement based on OT expertise

* Assessment of daily living, safety and supervision needs

* A written clinical summary explaining functional impact

* An Occupational Therapist–signed and stamped endorsement letter

Important clinical information

* This is a healthcare assessment service involving regulated professional clinical judgement.

* The assessment may be used to support an AA or PADP application.

* It may also be retained by the client for personal or medical records.

* This service constitutes clinical advice and healthcare provided by a regulated professional.

Clients may choose to receive the clinical assessment service alone and complete their own application form independently.

The clinical report and endorsed supporting letter are provided electronically.

2.2 Application Administration Support Service (Optional)

This is a non-clinical administrative service provided by AAS administrative staff.

This service includes:

* Completion of AA or PADP application forms using information derived from the clinical assessment

* Document formatting and preparation

* Printing and collation of application paperwork

* Assembly of supporting documentation

* Provision of pre-paid envelopes

* Postal submission to the DWP or Social Security Scotland (SSS)

* Liaison with DWP/SSS regarding application status

Important administrative information

* This service does not involve medical advice or clinical judgement.

* It is not delivered by healthcare professionals.

* It does not influence government decision-making.

3. Use of Services Together

Many clients choose to use both services:

1. A clinical assessment to accurately evidence health-related needs; and

2. Administrative support to manage application paperwork.

Each service remains contractually and commercially separate.

4. Confidentiality & Data Protection

We are committed to protecting your personal and medical information.

4.1 Use of Information

Your information will be used solely for:

* delivering the services you have requested; and

* submission of AA or PADP applications to the DWP or SSS where authorised.

4.2 Data Protection

We apply appropriate technical and organisational safeguards to protect personal data.

All clinical professionals:

* are HCPC-registered;

* are bound by professional confidentiality obligations; and

* hold appropriate professional indemnity insurance.

5. Client Responsibilities

By engaging our services, you agree to:

* provide accurate, complete and truthful information;

* disclose any existing benefit awards when requested;

* provide additional documentation if reasonably required;

* notify us promptly of changes to your circumstances.

You confirm that:

* you are of State Pension age;

* you are not currently receiving AA, PADP, PIP or DLA;

* your care needs have existed for at least six months.

You agree to:

* review and sign completed applications promptly;

* submit the endorsed application within seven (7) days of receipt;

* not amend, alter or add information prepared by the Occupational Therapist.

Failure to submit or unauthorised alteration of clinical content may compromise the application.

6. Fees and Payment

6.1 Fee Structure

Fees are confirmed during:

* the eligibility call;

* the clinical consultation; and

* where applicable, the administrative service confirmation.

Services are charged as:

1. Clinical Occupational Therapist assessment and report

2. Optional administrative support service

These are separate supplies for VAT purposes.

6.2 Payment Terms

* AAS operates a fixed professional fee with deferred payment.

* Payment becomes due only following a successful award and receipt of benefit payment from the DWP or SSS.

* If no award is made, all fees are waived.

Fees are normally covered by the initial backdated government award.

6.3 Exceptions Where Fees Remain Payable

Full fees become payable within 60 days of the clinical consultation where:

* the client chooses not to submit the completed endorsed application; or

* the application is rejected due to nondisclosure of existing benefits.

7. VAT Treatment

* Clinical assessment services provided by HCPC-registered Occupational Therapists are VAT-exempt healthcare services under Schedule 9, Group 7 of the VAT Act 1994.

* Administrative services are standard-rated for VAT, charged at the prevailing rate.

Invoices itemise these services separately.

8. Limitation of Liability

While AAS provides professionally led services, we cannot guarantee the outcome of any government benefit decision.

Our total liability is limited to the fees paid for the services supplied.

Where an application is unsuccessful, AAS bears all internal clinical and processing costs, including Occupational Therapist fees.

9. Termination

We reserve the right to suspend or terminate services where:

* these Terms are breached;

* misleading or false information is provided; or

* continued provision would breach professional or regulatory obligations.

10. Amendments

We may update these Terms periodically.
The most current version will always be available on our website.

Continued use of our services constitutes acceptance of updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

12. Complaints Policy

Attendance Allowance Services Ltd is committed to delivering a professional, ethical and clinically led service. We recognise that, on occasion, clients may feel dissatisfied or concerned about aspects of our service.

We view complaints as an opportunity to listen, learn and improve. This policy explains how clients can raise a complaint and how we will handle it fairly, transparently and in a timely manner.
